David Engelhardt is a seasoned litigator. His experience includes twenty years as a big-firm litigator and a more recent practice in the boutique setting. His matters have spanned antitrust, energy, construction, employment, insurance coverage, First Amendment, and commercial matters, with claims ranging from millions to billions of dollars. He joined Themis in June, 2013.
Mr. Engelhardt delivers impactful litigation services to commercial clients large and small and to individuals and families whether foreign or domestic. His nimble practice allows him to represent the best interests of his clients irrespective of their means or their industry. Recent engagements have included fraud and contract actions on behalf of a wealthy foreign family with investments worldwide; claims for back pay and benefits on behalf of federal workers mischaracterized as independent contractors; fraud and professional negligence claims on behalf of the heirs to a vast real estate fortune; professionals, senior executives, and military personnel involved in employment disputes; issues impacting the special-purpose investment vehicles of families and individuals; construction claims on behalf of an international energy project developer; a disgorgement claim on behalf of a hedge fund defrauded by its former advisor; and third-party discovery issues on behalf of an investment bank. He has successfully resolved matters in the areas of construction, financial fraud, professional malpractice, and employment law, and operates with ease in judicial actions, arbitrations and mediations throughout the United States.
Mr. Engelhardt has an established track record of achieving the best solution for his client, whether it means persuasively presenting the matter to the fact-finder in court or forging a confidential settlement that best serves his client’s needs. His resolve comes from his roots as a steelworker in Pennsylvania. He is confident in presenting issues of any size to any forum, whether millions are on the line for a corporate client, or dollars are at stake for a member of the work force. He approaches all cases, whether large or small, with the same determination. He works hard to ensure equal justice for all and takes pride in his pro bono work for three detainees on Guantanamo and two asylum-seeking survivors of the Rwandan genocide.
Mr. Engelhardt is admitted to practice in the District of Columbia, Pennsylvania, and various federal courts. He received his B.A. (English, Philosophy, Economics), summa cum laude, Phi Beta Kappa, from Bucknell University (1984), and his J.D., cum laude, from the Georgetown University Law Center (1989).
